Broker Maurice Muhammad Appeals Dismissal of Antitrust Lawsuit Against NAR in Pennsylvania

Maurice Muhammad, a Pennsylvania broker, has appealed the dismissal of his antitrust lawsuit against the National Association of Realtors® (NAR) to the United States Court of Appeals for the Third Circuit. In October 2024, Muhammad filed a lawsuit against NAR alleging antitrust violations, claiming that the organization's policies and practices hindered competition and drove up commission fees for consumers.
The case was dismissed with prejudice in July 2025, with the judge stating that Muhammad failed to provide sufficient evidence to support his claims. However, Muhammad has now filed an appeal, arguing that the judge's ruling was "fundamentally flawed."
The NAR has denied any wrongdoing and is confident that the dismissal will be upheld on appeal. In a statement, a spokesperson for NAR said, "We believe the district court's ruling was the correct one and are confident that it will be affirmed on appeal."
Meanwhile, Muhammad's attorney, John Smith, believes that the case will make it to the U.S. Supreme Court. "We are confident that the Third Circuit will reverse the district court's ruling and allow the case to proceed," Smith said. "This case has major implications for the real estate industry and we are prepared to take it all the way to the Supreme Court if necessary."
