Harry Gross’ G-Holdings seeks to downsize a mixed-use project planned by a rival developer, alleging it would harm his adjacent condo-hotel development.
New York-based developer Harry Gross, through his affiliate G-Holdings, has filed a lawsuit against the city of Aventura and developer Miami Off Center Associates to reverse zoning changes approved for Miami Off Center's planned mixed-use project in the neighborhood.
Gross argues that the proposed 17-story tower, called Cassa Residences, would negatively impact his own condo-hotel development located next door. The lawsuit alleges that the rezoning was done without proper consideration of the potential impacts on neighboring properties.
The Cassa Residences project, which includes 208 apartments and 12,000 square feet of ground-floor retail, is a joint venture between The Lojeta Group, based in Boca Raton, and a Delaware entity. The rezoning was approved last month and would allow for a higher density and larger building than originally planned for the site at 2770 Northeast 187th Street and 2822-2850 Northeast 187th Street.
"We believe the city failed to follow its own rules and procedures in approving this rezoning," said Gross' attorney, Mark Stein. "We are confident that the court will see the flaws in the process and reverse the decision."
The city has yet to respond to the lawsuit. Miami Off Center has not issued a statement regarding the legal action.
